Evaluation of Parental Capacity is distinct from and usually confused with the Evaluation of Child Custody. Within the context of Parental Capacity, the parent is assumed inadequate, and has been charged criminally and/or civilly with child maltreatment. Parental Capacity evaluations seek to determine the parent's functional capacity to parent the child(ren) despite any presenting risk factors including criminality, use of substances, or psychiatric diagnoses. Given Dr. Marshall's advanced acumen in this area, she is frequently retained to opine on matters of Parental Capacity, particularly with parents who are diagnosed with, or presenting with symptoms indicative of Intellectual Disability or Autism Spectrum Disorder. Notably, parents presenting with these diagnoses are overrepresented within the contexts of child maltreatment and have higher rates of termination of parental rights.
